1. Acceptance of Terms
These Terms and Conditions ("Terms") govern access to and use of Aiki, provided by Aiki Innovations Private Limited ("Aiki," "we," "us," or "our"). These Terms are entered into with the individual who registers for and operates the Account (the "User," "you," or "your"). By creating an account, clicking "I Agree," or otherwise using the Service, you represent that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated into these Terms by reference.
If you do not agree to these Terms, you must not use the Service. We may amend these Terms as described in Section 17.
2. Eligibility and Authority to Act on a Child's Behalf
To create an Account, you must be at least 18 years old and have reached the age of majority in your jurisdiction and legally capable of entering into a binding contract. The App is intended for use by adult Users; it does not permit a child to create or independently operate an Account.
If you provide, record, or enable the App to process personal information relating to a child (including but not limited to voiceprinting or transcribing speech) you represent and warrant that you are that child's parent or legal guardian, or that you have obtained the consent of the child's parent or legal guardian, to allow such processing through the App as described in our Privacy Policy. You are responsible for ensuring that any such consent has, in fact, been obtained before enabling the relevant feature.
3. Description of the Service
Aiki is an app designed to help parents better understand, guide, and connect with their children. By analysing and transcribing a child's interactions, it provides parents with meaningful, actionable insights into their child's experiences, emotions, and behaviours. Features, content, and availability may vary by device, region, and subscription tier, and may be updated, modified, or discontinued at our discretion, with reasonable notice for material changes affecting active subscribers.
4. Account Registration and Profiles
The User is responsible for maintaining the confidentiality of account credentials and for all activity occurring under the Account. The User agrees to provide accurate registration information and to promptly update it if it changes. The User may create and manage profiles within the Account — including a profile relating to a child or other individual, subject to Section 2 — configure settings such as preferences, upload profile photos and voice features (including enabling or disabling voiceprinting for a given profile), and review activity reports.
5. Acceptable Use and Community Standards
When using the Service, the User must not:

Use the Service for any unlawful purpose or in a way that violates these Terms;

Attempt to circumvent access controls, identity verification, or content settings;

Upload or transmit content that is abusive, obscene, hateful, or otherwise objectionable;

Attempt to interfere with, disrupt, reverse-engineer, or gain unauthorized access to the Service or its underlying systems, including any voice-processing infrastructure;

Collect or attempt to collect personal information about other individuals without appropriate authorization; or

Use any automated means (bots, scrapers) to access the Service.
We reserve the right to remove content, suspend features, or restrict access if we reasonably believe these standards have been violated.
6. Content, Intellectual Property, and Profile-Generated Content
All software, text, graphics, and other materials made available through the Service (excluding raw voice recordings, which we do not retain — see Section 7 and our Privacy Policy) are owned by Aiki Innovations Private Limited or its licensors and are protected by applicable intellectual property laws. Subject to these Terms, we grant the User a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes.
User Content created or stored in a profile, such as profile photos or voice transcripts, stays with that profile and is only used to provide the app's features. We do not make it public or share it with third parties unless you give us separate, explicit permission, and, where that content relates to a child, the consent of the child's parent or legal guardian. User grants us only the limited license necessary to store, display, and process that content in order to provide the Service.
7. Voice Interaction Terms
Use of any voice-based feature is governed by our Privacy Policy, which the User acknowledges by enabling such features. In summary: no audio recording of any individual's voice — including a child's — is retained once processed; only text transcripts are kept, subject to defined retention periods; and voiceprinting, where enabled, is used solely to identify the speaker and deliver personalized in-app suggestions, and for no other purpose.
8. Purchases, Subscriptions, and Virtual Items
8.1 Subscriptions and Automatic Renewal
If the User purchases an auto-renewing periodic subscription, the payment method on file will be billed continuously until the subscription is terminated. After the initial subscription period, and after any subsequent period, the subscription will automatically renew for an additional equivalent period unless cancelled before the renewal date through account settings or the relevant app store.
8.2 Pricing and Refunds
Prices are as displayed at the time of purchase and are subject to change with notice. Where a purchase is made through the Apple App Store or Google Play, refunds are governed by that store's policies. Where purchased directly through Aiki, refunds are governed by our refund policy and by applicable consumer protection law.
9. Advertising and Marketing
We do not use or share personal information relating to a user — including transcripts or voiceprint data — to select or target advertising. Any advertising shown within the App is limited to contextual, non-personalized advertising that meets applicable advertising standards, or is disabled entirely in ad-free subscription tiers. We do not use manipulative design patterns directed at obtaining a child's personal information or engagement.
10. Third-Party Services and Links
The Service may reference or link to third-party content or services. We do not control and are not responsible for the privacy practices or content of third parties. Where the App integrates a third-party SDK (for example, for crash reporting or payment processing), that vendor is contractually bound to comply with our data protection requirements, and is not permitted to use personal data for its own independent purposes, while recognizing that payment vendors may process data subject to their own privacy policies for financial compliance and fraud prevention.
11. Disclaimers and Limitation of Liability
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AIKI INNOVATIONS PRIVATE LIMITED SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM USE OF THE SERVICE. OUR AGGREGATE LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT PAID BY THE USER FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM. NOTHING IN THESE TERMS LIMITS ANY LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW, INCLUDING LIABILITY FOR OUR OWN FRAUD, WILLFUL MISCONDUCT, OR VIOLATION OF MANDATORY DATA PROTECTION OR CONSUMER PROTECTION RIGHTS THAT CANNOT BE CONTRACTUALLY WAIVED.
11.1 AI-Generated Content and Professional Advice Disclaimer
AI-Generated Output and Intent of Guidance: The User explicitly acknowledges and agrees that the Service utilizes advanced artificial intelligence (AI) models, machine learning algorithms, and automated linguistic analysis to process textual transcripts and voiceprint data. While the core design and programmatic intent of the App is to synthesize this data to deliver the most relevant, appropriate, useful, and contextually tailored guidance and suggestions for the User (collectively, "AI Output"), the User acknowledges that all such output is generated algorithmically and must be treated strictly as automated AI analysis.
No Substitution for Professional Advice: THE USER AGREES THAT DESPITE THE AIKI’S INTENT TO PROVIDE BENEFICIAL DATA INSIGHTS, NO AI OUTPUT IS A SUBSTITUTE FOR, AND SHALL NOT BE RELIED UPON AS, PROFESSIONAL MEDICAL, PSYCHOLOGICAL, PAEDIATRIC, EDUCATIONAL, OR SPEECH-LANGUAGE THERAPY ADVICE, DIAGNOSIS, OR TREATMENT. While we consistently strive to ensure the exceptional quality of our service, we make no absolute representations or warranties regarding the clinical accuracy, completeness, or absolute safety of any AI Output, which should always be evaluated alongside professional guidance.
The User maintains ultimate operational responsibility for evaluating, verifying, and implementing any insights generated by the App on behalf of the minor child. The User is strongly encouraged to seek the advice of a qualified physician, pediatrician, or other certified healthcare or educational professional with any questions he or she may have regarding a minor child’s developmental milestones or health conditions. Reliance on any AI Output provided by the App is executed solely at the User’s own risk, one should never disregard professional advice or delay seeking it because of information or suggestions generated by the App.
12. Indemnification
The User agrees to indemnify and hold harmless Aiki Innovations Private Limited, its officers, directors, employees, and affiliates from any claims, damages, or expenses (including attorneys' fees) arising from the User's breach of these Terms or misuse of the Service, except to the extent such claims arise from our own breach of these Terms or applicable law.
13. Suspension and Termination
The User may close their Account at any time through account settings or by contacting support@aikiglobal.com, after which the associated data will be deleted in accordance with our Privacy Policy. We may suspend or terminate access to the Service if we reasonably believe these Terms have been violated, if required by law, or if necessary to protect the safety of a Data Subject, and will provide notice to the User where practicable. Sections 6, 11, 12, 14, and 18 shall survive any termination.
14. Governing Law and Dispute Resolution
These Terms, and any dispute arising out of or relating to them or the Service, shall be governed by the laws of India, without regard to conflict-of-laws principles. Subject to the mediation/arbitration provisions below, the courts of Bengaluru, India shall have exclusive jurisdiction, provided that nothing in this Section limits a Parent's non-waivable right, under certain jurisdictions, to bring a claim before a local court or regulator concerning a child's personal data.
Where the Parent is located outside India and mandatory local consumer-protection or children's-privacy law grants additional dispute-resolution rights (such as a right to bring a claim in local small-claims court, or to invoke a domestic arbitration/ombudsman scheme), those mandatory rights are not displaced by this Section.
Prior to initiating formal proceedings, the parties agree to attempt to resolve any dispute through good-faith negotiation by providing written notice of the dispute to the other party, followed, where the dispute is not resolved within 30 days, by mediation or arbitration in accordance with the Arbitration and Conciliation Act, 1996, seated in Bengaluru, India, conducted in the English language, with a sole arbitrator appointed by mutual agreement of the parties. This clause does not apply to claims that qualify for resolution before a consumer forum under the Consumer Protection Act, 2019, which the Parent may pursue instead if eligible.
15. Jurisdiction-Specific Terms
Where mandatory local law provides additional or different rights than those set out above (for example, statutory withdrawal rights in the EU, small-claims rights in the United States, or consumer guarantees in Australia that cannot be excluded), those mandatory rights apply and take precedence over any conflicting provision in these Terms. 16. Grievance Officer / Complaints
In accordance with the Information Technology Act, 2000, the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, and the Consumer Protection (E-Commerce) Rules, 2020, Aiki Innovations Private Limited has appointed a Grievance Officer to address complaints regarding the Service, who may be contacted at:

The Grievance Officer will acknowledge any complaints within the timeframe prescribed by applicable law and work to work to resolve it within the statutory timeline of 15 to 30 days.
17. Changes to These Terms
We may revise these Terms from time to time. If we make a material change, we will notify the User by email and/or in-app notice at least 14–30 days before the change takes effect (except where an immediate change is required for legal or safety reasons). Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
18. Miscellaneous

Entire Agreement: These Terms, together with our Privacy Policy and any Additional Terms disclosed for specific features, constitute the entire agreement between the User and Aiki regarding use of the Service.

Severability: If any provision of these Terms is held unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

No Waiver: Our failure to enforce any right or provision will not be considered a waiver of that right or provision.

Assignment: The User may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.

Language: These Terms are written in English. Any translated version is provided for convenience, and the English version controls in the event of a conflict.
